In California, new ADU laws permit several kinds of accessory dwelling units on any multi-family property.
A multi-family residence is a building that houses more than one family. Each unit has a kitchen and bathroom, a separate entrance, and its own utility measure. Duplexes, triplexes, small apartments, townhomes, three-flats, anc condo buildings are all examples of multi-family residences.
There are two kinds of ADUs that can be built on a multi-family property: detached ADUs and conversion ADUs. A detached ADU is a completely free-standing structure that is unattached to the main multi-family structure; a conversion ADU converts existing “non-livable space” in the main multi-family structure into a new ADU (e.g. a storage room, boiler room, passageway, attic, basement, or garage).
Detached ADUs on a multi-family lot are subject to a height limit of 16 feet and four foot rear and side yard setbacks.
Conversion ADUs that are inside the main structure on a multi-family lot are treated as part of the main structure and take on the same requirements as the main structure. For example, if an apartment building is served by fire sprinklers, and the ADU is inside the building, it will also need to be served by fire sprinklers.
